Laguna Waterworks, Inc. shall not under any circumstances be liable for special, incidental, or consequential damages such as, but not limited to, damage or loss of other property or equipment, loss of profits or revenue, cost of capital, cost of purchased or replacement goods or related claims of a customer. Customer’s remedies set forth herein are exclusive. The liability of Laguna Waterworks, Inc. under these Terms and Conditions, or from negligence, strict tort or under any warranty otherwise, shall not exceed the price of goods upon which such liability is based (unless Laguna Waterworks, Inc. elects to repair or replace such goods at its own expense and such repair or replacement exceeds the price of the goods). Laguna Waterworks, Inc. reserves the right to sell certain goods “AS IS”, without any warranty whatsoever, by indication on the invoice or sales receipt for such goods.

The laws of the State of California shall govern all matters relating to the enforcement or interpretation of this sale transaction and this statement of Terms and Conditions. The parties to this sales transaction hereby consent to exclusive jurisdiction and venue by the courts of the State of California as the location where the sale contract was made, and agree that any suit or action to enforce or interpret any matter relating to this transaction may be brought only in the courts within the State of California in Orange County.

We know your purchase will bring you enjoyment, but if for any reason you are not satisfied with your purchase you may return your purchase for a refund (less any additional shipping or special charges). NOTE: Restocking fees of 20% may apply. You must retain all original packing and crates/boxes as your return must be sent back in its original container for a refund.

Returns other than those due to manufacturing defects or damage from shipping must be sent prepaid by consumer and insured for the full purchase price. All returns must have a Laguna Water Works' Return Authorization Number. Retain all original packing and crates/boxes as your return must be sent back in its original container.

Bio Fire Fuels may not be returned due to their volatility and potential for tampering.

** Please note that stone is a natural product and all our products are handcrafted. Sizes, textures, weight and colors are approximate and may vary from item to item making each truly unique.

Returns due to Damage or Defect
Damaged products must be reported to Laguna Water Works within 3 days of receipt. Please note specifics about damages at the time of delivery, on delivery receipt, for crates and boxes that arrive from the freight company damaged. For returns due to shipping damage or manufacturer defect please contact your Laguna water Works representative for a Return Authorization Number to accompany your return. Retain all original packing and crates/boxes as your return must be sent back in its original container. We will replace the damaged or defective item at no cost to you.

Adagio Water Feature Purchase

• If there are any damages, note the damage on the Delivery Receipt and ACCEPT the shipment.
• If you are unable to open and inspect the shipment, please write "Possible Concealed Damage" on the delivery ticket and give to the driver. (Do not refuse the shipment).
• You MUST report damage to Adagio within 48hrs. (Monday-Friday).
• If not reported within 48 hours, you will be responsible to file a claim (yourself) with the freight carrier.
• Pictures of the packaging and all damages will need to be emailed to Adagio. Once these pictures have been received, Adagio will send out replacement parts.

Shipping
Laguna Waterworks offers Free Ground Shipping on all fountains and fireplaces anywhere in the contiguous 48 states. US Priority Mail Service and/or other delivery services are offered as a convenience for an additional fee and is noted for those products which these services are offered. Please know that US Priority Mail is not a guaranteed service and all delivery times are approximate.

We cannot accept P.O. Box addresses for our Free Ground Delivery Service, please supply us with a physical address either residential or commercial. P.O. Boxes are allowed as delivery destinations for US Priority Mail Service Only.

Shipments to Alaska and Hawaii
Shipments to Alaska and Hawaii require additional shipping charges as these deliveries can only be sent by air. If the US Priority Mail option is available it may be selected for shipments to Hawaii and Alaska. If the US Priority Mail option is not available please call us toll-free at 1-800-427-6123 for rates and ordering.

Shipping Times
Once we receive your order, we begin processing your request. Lead times are noted for all products, these production schedules are updated weekly. If your item is back-ordered you will be notified of the intended shipping date or if you require the item shipped after a certain date we ask that you notify us. If you are unavailable to take delivery please make arrangements for someone to be present to accept delivery for you.

Failed Delivery
Laguna Water Works offers free "Curbside" Ground Shipping on all fountains and fireplaces to any destination in the continental US, we do not however offer free storage for your undeliverable purchases. If, after several attempts to effectuate proper delivery have failed you may be charged with additional fees such as daily storage and/or return shipping charges.

Laguna Waterworks recommends all orders be inspected upon delivery to insure unit is received in good condition and correct item is received. Laguna Waterworks will not be held responsible for damaged or mis-shipped units uninspected upon receiving. Customer will be responsible for all shipping cost on mis-shipped or damaged units uninspected upon delivery.
